By accessing, subscribing to, or using the Matmon Portal, you agree to be bound by the following Terms & Conditions. If you do not agree, do not proceed with subscription or use of the service.

1. Service Description

The Matmon Portal is a white-labeled customer relationship management and communications platform made available by Matmon. The Portal provides access to tools for managing contacts, communications, appointments, workflows, and related business activities.

Matmon is not the owner, developer, or licensor of the underlying software infrastructure. The Matmon Portal is powered by third-party technology providers.

2. Role and Scope of Matmon

Matmon’s role is limited to:

Providing access to the Matmon Portal

Offering configuration guidance and usage support

Sharing general best-practice recommendations

Matmon does not provide legal, compliance, financial, or marketing performance guarantees. Matmon does not guarantee outcomes including but not limited to lead generation, revenue, conversions, or business growth.

3. Third-Party Technology Acknowledgment

You acknowledge and agree that:

The Matmon Portal relies on third-party software and infrastructure

Features, functionality, availability, and performance may change without notice

Service interruptions or outages may occur

Matmon shall not be liable for downtime, data loss, service degradation, or feature changes caused by third-party providers.

4. Communications and Legal Compliance Responsibility

If you use email, SMS, voice, or messaging features, you are solely responsible for:

Obtaining proper consent from recipients

Compliance with TCPA, A2P messaging rules, CAN-SPAM, and other applicable laws

Message content, frequency, and delivery practices

Matmon provides tools and guidance only and assumes no liability for violations, fines, or enforcement actions resulting from misuse.

5. Data Ownership and Responsibility

You retain ownership of all data uploaded or managed within the Matmon Portal.

You are responsible for the legality, accuracy, and appropriateness of all data and for ensuring you have the right to use and communicate with your contacts.

6. Billing, Fees, and Cancellation

Subscriptions are billed on a recurring basis unless otherwise stated.

You may cancel at any time. Cancellation stops future billing but does not refund prior charges.

Matmon may suspend or terminate access for non-payment or misuse.

7. Suspension and Termination

Matmon may suspend or terminate access if you violate these Terms, misuse the platform, or expose Matmon to legal, technical, or reputational risk.

8. Limitation of Liability

To the maximum extent permitted by law, Matmon’s liability is limited to the amount paid during the current billing period.

Matmon is not liable for indirect, incidental, consequential, or business interruption damages.

9. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of the State of Arkansas.

Any legal action related to the Matmon Portal or these Terms shall be brought exclusively in state or federal courts located in Pulaski County, Arkansas.

10. Acceptance

By subscribing to or using the Matmon Portal, you confirm that you have read, understood, and agreed to these Terms & Conditions.
